Following reports of a man driving while drinking a beer on a highway in Dutchess County an Orange County man was arrested for a felony DWI.

Monday New York State Police from East Fishkill arrested David D. McCarthy, 59, of Montgomery for driving while intoxicated, a class E felony. McCarthy received a felony charge due to a previous DWI related conviction within the past 10 years.

Troopers were contacted by an unnamed person who reported that there was a man driving a red Buick on Interstate 84 who appeared to be drinking a beer while he was driving.

Police located the alleged suspect and pulled him over on I-84. Authorities say McCarthy was found to be intoxicated at the time of the traffic stop.

McCarthy provided a breath sample that allegedly revealed a Blood Alcohol Content of .09%.

He was arraigned in the Town of Fishkill Justice Court and released on his own recognizance. McCarthy is due to appear in City of Beacon Court on June 15.
