A wanted New Hampshire man is accused of stealing from a Hudson Valley Home Depot and more.

On Halloween around 11:30 a.m., deputies from the Putnam County Sheriff’s Office responded to a 911 report of two suspicious men in the parking lot of the Southeast Home Depot Store located on Independent Way.

Police were told the men were walking around the parking lot and looking into vehicles.

Arriving officers found two men sitting in a parked vehicle in the Home Depot parking lot. As police investigated, they learned that 22-year-old Dustin P. Averill of New Hampshire had an active arrest warrant for larceny in New Hampshire.

A further investigation revealed that Averill was in possession of an item that was stolen from the Home Depot, police say.

A store employee recognized the stolen item and told authorities he wanted to file criminal charges. Averill was charged with petit larceny, a misdemeanor.

During the arrest process, Averill was allegedly found to be in possession of a controlled substance. Averill was additionally charged with criminal possession of a controlled substance, a misdemeanor.

Averill was arraigned at the Town of Carmel Justice Court on behalf of the Town of Southeast and committed to the Putnam County Correctional Facility in lieu of $1,500 cash bail pending a future court appearance.

If found guilty of the misdemeanor charges, Averill could face up to a year in jail and a fine of up to $1,000 for each charge.
