The New York State Attorney General enforces New York’s price gouging statute, section 396-r of New York General Business Law, which prohibits unconscionably excessive pricing of necessary consumer goods and services during an abnormal disruption of the market, officials say.

During the COVID-19 pandemic, price gouging applies to necessary consumer goods such as hand sanitizers and other disinfecting products, toilet paper and basic food items, according to the New York State Attorney General's Office.

Some products and services, like face masks, may not be covered by New York State’s price gouging law. Face masks aren't covered because the CDC and the Surgeon General do not recommend face masks as necessary for the general public during the COVID-19 outbreak, officials say.
