Can a Landlord Just Enter Your Apartment Without Notice?
Have you been renting an apartment in the area and having an issue with your landlord? Is it legal for your landlord to enter your apartment without notice?
If you live in Ulster County, there is a great resource on the counties website under the heading Rights and Obligations of Landlords and Tenants. On that website it gives you a great deal of information about your rights as a renter, but it also gives you a better idea of what to expect from your landlord.
For instance, here is what they have to say about whether or not your landlord can just drop by and have access to the property or being on the property without you being home:
Entry into the apartment by the landlord or landlord's agent(s) must be during reasonable daytime hours, unless the tenant requests otherwise. The tenant has a reasonable expectation of privacy which the landlord needs to respect. However, a landlord has the right of immediate access in case of an emergency involving a danger of loss of life, serious bodily harm or substantial damage to property.
