Do You Need To Disclose If Someone Died in Your Home?
Many residents in New York are confused if you are supposed to disclose this information or not.
A lot of people are trying to buy a home in New York and there's a lot of people who are selling their home to go to other areas. The people who are looking to buy have had a very difficult time because homes are so expensive here and they've been getting outbid by people who have higher, better and cash offers. Recently, people who want to be homeowners here have had to changed what's important to them in a home and just buy something they might not be exactly thrilled about just to say they are a homeowner in New York.
However, would you go as far as owning a home someone passed away in? If you're the one selling and you just want to leave and get out, would you disclose that someone passed away in your home?
Are you supposed to disclose if someone passed away in your home in New York if you're trying to sell it?
According to officials, you DON'T need to disclose if there was a death in your home in New York because it's not a material defect. Not going to lie, I'm pretty shocked about that and I would surely want to know if someone died in the home I was about to purchase. However, it is always recommended to be honest with the person who is buying your home and if they flat out ask you if someone passed away in your home you are expected to answer truthfully, Officials say, if you do lie about this you could potentially face some legal trouble down the road.
Again, I'm pretty surprised by this.
Bottom line it's always best to be honest and with how difficult it is to buy a home these days it doesn't seem like someone passing away in a house will really stop someone from buying it.
