A Hudson Valley dentist who was once accused of killing his lover’s husband was found guilty on lesser charges.

Thursday in Orange County Court, 49-year-old Gilberto Nunez of Poughkeepsie was found guilty of perjury, offering a false instrument for filing and making an apparently sworn false statement in connection with false statements he made on a pistol permit application.

At the trial, prosecutors argued that Nunez had perjured himself when he said he wasn’t terminated or discharged from employment or from military service for cause.

According to the Orange County District Attorney’s Office, in 1990, Nunez was discharged from the Marines under “other than honorable conditions”. This discharge occurred after Nunez had been detained after he went AWOL for almost three years. Nunez went AWOL eight days into his first Marines assignment.

In June, Nunez was found not guilty of second-degree murder. The Kingston dentist was accused of killing 44-year-old Thomas Kolman of Saugerties by giving him coffee laced with a dental sedative.

Kolman’s body was found inside his car at a gym parking lot in Ulster County in Nov. 2011.

The Ulster County District Attorney’s Office previously said Nunez’s SUV was seen on video surveillance traveling to and from the scene. Officials alleged Nunez was having an affair with Kolman’s wife, Linda.

In Oct. 2015, the D.A.’s office said Kolman was killed by a sedative called Midazolam, a drug that is only available to dentists and can’t be purchased by the public.

Investigators say they found a search history for the drug on Nunez’s computer.

Nunez’s defense team argued that Nunez had nothing to do with the death. Citing Kolman’s heart condition and sleep apnea as possible factors.

In late Oct, a jury trial convicted Nunez of seven felonies in connection with insurance scam.

Nunez is scheduled to sentenced on Feb. 7. He was remanded to the Ulster County Jail without bail.
